If buying without an OS, it will have test/not fully configured version of Win 10 on it that was used for testing purposes, what I normally do is make sure it boots properly and do a few tests just to make sure everything seems to be working fine, then the best bet is to do a full clean install...

The memory/clock speeds raise and fall with demand, so they can go up and down, my 3070 is sat at about those low values at the mo as well cos I'm not doing anything graphically intensive at all - but even during something intensive it will often go up and down as well
Generally they are Palit or Zotac branded NVidia cards, though sometimes they can be other brands eg. the one I got was a Gigabyte (mine was an upgrade from them)

I suspect it's because with any drivers it may kill Windows if something goes horribly wrong but a Windows reinstall will sort it all out, whereas if a BIOS update goes wrong or if its the wrong one it can brick the machine and be a lot lot lot more effort to fix (if it can be)
